A binding contract between Gianni - a musical emotion and the client (organizer) comes about through mutual signing of the engagement contract. The contract is sent by Gianni to the client by mail, e-mail or fax. Only after signing and returning the contract to Gianni - a musical emotion, the contract becomes effective and binding.
A commitment via WhatsApp, e-mail, telephone or SMS is also legally binding. For this purpose,
a timely clear declaration of intent on the part of the client is sufficient. (Confirmation of the booking and mutual agreement on the terms.
The scope of the performance obligation results exclusively from the service description in the engagement contract.
The band is obliged to notify the client of any changes or deviations immediately. Offers are subject to change.
Changes to the contract services must be in writing.
Offers and quotations for Gianni - a musical emotion are not binding. Costs incurred in connection with the performance of the event (eg GEMA fees) are to be borne by the client. Gianni - a musical emotion ,, is entitled to invoice for a service immediately after it has been rendered. Invoices are due immediately upon receipt, but no later than 10 days after service provision without deduction. In the event of late payment,
default interest in the amount of 4 percentage points above the applicable base interest rate shall be deemed agreed.
The nullity or invalidity of individual provisions of these terms and conditions shall not affect the validity of the remaining provisions. The place of jurisdiction for all claims arising from the contractual relationship is Bielefeld. The law of the Federal Republic of Germany.
